Instead, all individual Service Providers and Companies using the Smart App platform are responsible for obtaining their own required background checks through a qualified third-party background screening provider and providing valid background check documentation to My Smart App LLC before providing services to customers.

The cost of obtaining a background check is the responsibility of the individual Service Provider or registered Company. My Smart App LLC does not pay for, reimburse, or manage background screening fees.

Every individual who provides services through the Smart App platform must complete and provide a current background check report before accepting customer bookings.

• Freelancers
• Professionals

• Translators
• Contractors
• Employees or team members assigned by registered Companies

Companies that register on Smart App and assign employees, contractors, or team members to provide services must ensure that each individual has completed the required background screening and that valid documentation is provided to My Smart App LLC.

Background check reports provided to My Smart App LLC may include, depending on the service category and applicable requirements:

• National criminal history searches
• County criminal history searches
• Sex offender registry searches
• Motor vehicle record checks (when driving is required)
• Professional license verification (when applicable)
• Other legally required screening information

My Smart App LLC may review submitted background check documentation to verify that providers meet platform safety requirements.

Each Service Provider is responsible for:

• Obtaining their own background check from a qualified third-party screening company.
• Paying all costs associated with the background check.
• Providing accurate and current background check documentation to My Smart App LLC.
• Updating background check information when requested.
• Maintaining all required licenses, certifications, and insurance.

Failure to provide valid background check documentation may result in delayed approval, suspension, or removal from the Smart App platform.

Companies that register with My Smart App LLC and provide services through their employees, contractors, or team members are responsible for:

• Obtaining background checks for every individual who provides services to Smart App customers.
• Paying all background check costs for their employees, contractors, or assigned service members.
• Providing background check documentation for each individual service provider.
• Ensuring all team members maintain required licenses, certifications, insurance, and qualifications.
• Removing any individual from the platform who no longer meets safety or eligibility requirements.

A Company registration does not replace the requirement for individual background checks. Every person who interacts with customers or performs services must have their own approved background check documentation.

Service Providers and Companies are responsible for maintaining all required insurance and legal documentation, including:

• General liability insurance
• Automobile insurance (when applicable)
• Professional liability insurance (when applicable)
• Business licenses
• Professional certifications
• Any other insurance or permits required by federal, state, or local laws

My Smart App LLC acts only as a platform connecting customers with service providers and does not provide insurance coverage for Service Providers or Companies.

My Smart App LLC may request updated background check reports or supporting documentation at any time to maintain platform safety standards.

Providers and Companies are responsible for ensuring all submitted information remains accurate, current, and valid.

Providing false, incomplete, expired, or misleading background check information may result in immediate suspension or removal from the Smart App platform.

My Smart App LLC is a technology platform and marketplace connecting customers with independent Service Providers and Companies.

My Smart App LLC:

• Does not employ Service Providers or Company employees.
• Does not conduct background checks.
• Does not pay background screening fees.
• Does not guarantee the performance, qualifications, or conduct of any independent Service Provider or Company.

Service Providers and Companies remain solely responsible for their background checks, insurance, licenses, qualifications, and the quality and safety of services provided to customers.

By using the Smart App platform, Service Providers and Companies agree to provide accurate documentation and maintain compliance with all applicable laws and regulations.
